1. Introduction

This Privacy Policy explains how LG Electronics, Inc. ("LGE") process any personal information we collect from you, or that you provide to us when you interact with our Open Source website (collectively, the "Sites").

Please read the following carefully to understand our views and practices regarding your personal information and how we will treat it. This Privacy Policy applies to [https://opensource.lge.com] and any other websites and services controlled by LGE where this Privacy Policy is posted or referenced (collectively, the "Sites").

The Sites may provide access to websites and links to other services owned and operated by third parties. These third-party services are outside the scope of this Privacy Policy and have their own policies that apply to the collection, use, and sharing of information in connection with their services. We encourage you to read those policies. LGE is not responsible or liable for the privacy practices of such third parties.

2. What information does LGE obtain?

LGE may collect and store the Personal Information that you have provided to us. Below are some examples of the Personal Information we may collect on the Sites:

• Basic identifying and contact information, such as your name, IP address, and email address, which allows us to respond to your inquiries and provide support.

• When you interact with our Sites, for example by submitting an inquiry, we may collect additional information such as the product model name, inquiry details, and any attachments you choose to provide.

• Communication records when you communicate with our customer service staff or other LG Group staff.

The above list is not exhaustive but provides examples of the Personal Information that may be collected on the Sites where provided by you.

3. How will LGE use the information it obtains?

We may use your information that is collected on the Sites for the following purposes:

• To complete a transaction or service requested by you;

• To operate, evaluate and improve our business (including developing new products and services; enhancing and improving our service; analyzing and reviewing our user base and service, performing data analytics and market research, and performing accounting, auditing and other internal functions);

• To communicate with you about changes to our Privacy Policy or the Terms of Use of the Service, if necessary;

• To contact you in response to your submitted Enquiry and other queries;

• To protect and defend our rights and property, including by way of legal proceedings;

• To ensure compliance with legal obligations and regulatory requirements; and

• For our internal administrative and record keeping processes (e.g. management of website accounts, logging of queries etc.).

We use your Personal Information for these purposes on the lawful basis that such use of your personal information is necessary for LGE: (i) to fulfil a contract that we have in place with you, for example, to deliver the products or services you have purchased from us, (ii) for the purposes of our or a third party’s legitimate interests (including our legitimate commercial and related interests, such as understanding our customers and potential customers and providing you with information on our products and services), (iii) for compliance with a legal obligation to which we are subject, or (iv) where you have given us your consent.

Where we rely on our legitimate interests, we have carried out a balancing test to consider what the impact of the processing will be on individuals and to determine whether individuals‘ interests outweigh our interests in the processing taking place. You can obtain more information about this balancing test by using the contact details at the end of this Privacy Policy.

4. Sharing and Disclosure of Information

We may share your information as described below:

For Our Business Purposes. We may share information we collect with outside entities for our own business purposes. We share this information to provide or otherwise enable your use of features and functions on the Sites, and for various internal purposes. More information on the reasons we share information can be found below.

To provide services to you. We may share information with our service partners who help us maintain our Sites and provide other administrative services to us (including, but not limited to, maintaining and analyzing data, and sending customer communications on LGE's behalf)

For Legal Reasons. We may share all of the above categories of information with service partners or other outside entities as necessary to comply with our legal obligations, including compliance with any applicable law, legal process, or court order. We may also share information in order to protect and defend the rights of LGE, our users, or any other individual, to protect against fraudulent or malicious activity, or to cooperate with law enforcement agencies.

In Connection with a Sale or Merger. If we directly or indirectly undergo a business transition (including proposed transactions), such as a merger, acquisition by another company, or sale of all or part of our assets, we may share all of the above categories of information to the successor or potential successor organization, as well as their professional advisors during the transition.

• When you otherwise consent to such disclosure. We may share certain information with service partners or other entities when you direct us to share or otherwise consent to our sharing such information.

Except as described in this Privacy Policy or at the time we request the information, we do not otherwise use, share or otherwise disclose your Personal Information to any third parties. LGE will take commercially reasonable steps in order to ensure any such third parties treat your Personal Information securely.

5. Retention

We take appropriate steps to ensure that we process and retain information in accordance with the following principles:

• at least for the duration for which the information is used to provide you with our Services;

• as required under law, a contract, or with regard to our statutory obligations (e.g., tax laws);

• for as long as it is reasonably necessary to do so to manage an actual or apprehended complaint, investigation or legal dispute;

• only for as long as it is necessary for the purpose for which it was collected, is processed, or longer if required under any contract, by applicable law, or, in anonymized form, for statistical purposes, subject to appropriate safeguards. For example, if a dispute arises between you and the LG Group or you fail to make payment for our Services, we may retain relevant information until such dispute is resolved or until such payment is made, respectively. If you delete your entire LG Account, your information will be retained for three months and immediately destroyed thereafter, unless otherwise required under applicable law.

• Where we process your information, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data indefinitely so that we can respect your request in future.

6. International Transfer of Information

Your use of our Services will involve the transfer, storage, and processing of your personal information within and outside of your country of residence, including the Republic of Korea and the United States. Please note that data protection laws and other laws of countries to which your information may be transferred might not be as comprehensive as those in your country.

[For European Residents]

If you are in the EEA (European Economic Area, that is in the European Union and Iceland, Lichtenstein, Norway), UK or Switzerland, we will transfer your personal information to other countries outside the EEA, UK or Switzerland, including the Republic of Korea and the United States. European Union Law recognises the Republic of Korea as adequately protecting personal information. However, where we transfer your personal information to a jurisdiction which is not considered adequate by applicable law, we will take appropriate measures, in compliance with applicable laws, to ensure that your personal information remains protected. Such measures include for instance the use of model clauses which have been approved by the EU, UK and Switzerland. In some instances, we will rely on your explicit consent, where this is appropriate. To request more information or obtain a copy of the contractual agreements or other safeguards in place, use the contact details set out in the “Contacting LGE” section below.

7. Your Rights

To the extent provided by applicable law, you can ask us for a copy of the personal information we hold about you. You can also ask us to delete personal information or correct any inaccuracies, to restrict or limit the processing of your personal information, to withdraw your consent and to provide you with personal information that you provided to us for a contract or with your consent in a structured, machine readable format, and to ask us to share (port) this data to another controller.

In addition, to the extent provided by applicable law, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement).

However, these rights may be limited, for example if fulfilling your request would reveal personal data about another person, where they would infringe the rights of a third party (including our rights) or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping. Relevant exemptions are included in both the GDPR and in national laws. We will inform you of relevant exemptions we rely upon when responding to any request you make. To make a request concerning your rights or to make an inquiry, use the contact details under the “Contacting LGE” section below.
